Marriage or a registered partnership with a partner from abroad gives you a statutory package of rights in the Netherlands: a shared estate, a statutory inheritance right, usually a partner pension, and a residence route in which the marriage certificate proves the relationship. Unregistered cohabitation creates almost nothing automatically; every protection must be arranged yourself through a cohabitation agreement, a will, a pension registration and a power of attorney.
The important exception for international couples is applicable law: depending on where you lived after the wedding, foreign rather than Dutch property law may govern your marriage. This page sets out the differences and what to arrange.

What does the choice of relationship form change?
Marriage (huwelijk) and registered partnership (geregistreerd partnerschap) are changes of civil status, recorded in the Personal Records Database (BRP). From that moment statutory rules in Book 1 of the Dutch Civil Code (BW) apply to you, whether you have read them or not.
Unregistered cohabitation is not a civil status. Twenty years of living together, a joint mortgage and children do not by themselves make you each other’s heir, pension beneficiary or legal representative. When one partner comes from abroad, a third party is also involved: the Immigration and Naturalisation Service (IND), which asks for documentary proof of the relationship.

How does your relationship affect a Dutch residence permit?
For a partner from outside the EU, marriage or a registered partnership removes one hurdle: proof that the relationship is durable. The other requirements stay the same, including the income requirement and a minimum age of 21 for both partners.
A partner with the nationality of an EU or EEA country or Switzerland does not need a residence permit from the IND; their right of residence follows from EU law. They register with the municipality if they stay longer than four months.
Other partners usually need a provisional residence permit (machtiging tot voorlopig verblijf, mvv), which is applied for together with the residence permit in one procedure, normally by the sponsor in the Netherlands. Under Article 25 of the Aliens Act 2000 (Vreemdelingenwet 2000) the IND must decide on a residence permit application within 90 days, a period it can extend. Since 15 April 2025 the IND no longer owes a penalty for late decisions; you can, however, appeal against the failure to decide and the court can order a decision within a set period.
What must the sponsor prove?
The sponsor in the Netherlands must prove three things: sufficient and lasting income, the relationship, and in most cases the partner’s civic integration abroad. The IND publishes the income amounts, which change on 1 January and 1 July; check the current figure on ഇൻഡ്.എൻ.എൽ on the day you apply.
- Income: at least the level set by the IND, linked to the statutory minimum wage, and normally available for at least one year after the application.
- Relationship: a marriage or partnership certificate, or for unmarried partners proof of a durable and exclusive relationship plus a signed relationship declaration. The IND looks at joint registration, a shared tenancy or mortgage and a consistent history.
- Civic integration: many partners must pass the basic civic integration exam abroad at a Dutch embassy before the mvv is granted. Nationals of certain countries and Turkish nationals are exempt, as are people who cannot take the exam for medical reasons.
Does marriage give your partner a right to stay?
No. Marrying in the Netherlands does not create a right of residence. Under Article 1:62 BW the ceremony cannot take place earlier than the fourteenth day after the notification of the intended marriage, and the registrar can ask the IND for advice if there are signs of a marriage of convenience.
A partner who married here during a short-stay visa will in almost all cases have to return and apply for the mvv from abroad. Our guide to നെതർലൻഡ്സിലെ കുടുംബ പുനരേകീകരണം sets out the procedure, and the glossary entry on the താമസ അനുമതി explains the terms the IND uses.
What happens to property and debts?
A marriage concluded on or after 1 January 2018 without a prenuptial agreement falls under the limited community of property (beperkte gemeenschap van goederen, Article 1:94 BW). What each partner owned before the wedding stays private; what is acquired during the marriage becomes joint, and property already owned jointly before the wedding, such as a house bought together, falls into the community.
Gifts and inheritances stay private. In practice private and joint money soon mix in one account, and the partner who claims a sum was private must prove it. Keep separate accounts for private capital and keep the transfer records.
Which country’s property law applies?
For marriages concluded on or after 29 January 2019, the EU Matrimonial Property Regulation determines the applicable law. Its main rule points to the law of the state of the spouses’ first common habitual residence after the wedding; a parallel regulation applies to registered partnerships.
A couple who marry in the Netherlands and move to Germany six weeks later may therefore have a marriage governed by German property law. You can choose the applicable law, in the form required for a prenuptial agreement, which in the Netherlands means a notarial deed. Couples married before 29 January 2019 fall under older conflict rules.
What do cohabiting partners share?
Nothing by default. Income, savings and debts stay with the partner in whose name they are, and there is no maintenance obligation and no equal division when the relationship ends.
That becomes harsh when one partner moved here for the other, gave up a career or paid into a house in the other’s name. Claims afterwards, such as unjust enrichment (Article 6:212 BW), are litigation, not certainty. A notarial cohabitation agreement (samenlevingscontract) records ownership shares in the home, the division of costs and the consequences of separation. Our comparison of a ഡച്ച് നിയമപ്രകാരമുള്ള സഹവാസ കരാറും വിവാഹവും goes through the clauses, and the article on വിവാഹത്തിനുള്ളിലും വിവാഹത്തിനു ശേഷവുമുള്ള സ്വത്ത് covers the married position.
Married couples and registered partners are tax partners for the Tax and Customs Administration (Belastingdienst); cohabiting partners only under specific conditions. We do not give tax advice; ask a tax adviser how this affects a partner who recently moved to the Netherlands.
What about inheritance, pension and medical decisions?
A spouse or registered partner is a statutory heir. Under the statutory division of Article 4:13 BW the surviving spouse receives all assets of the estate, and the children receive a claim in money against the survivor that normally becomes payable only on the survivor’s death or bankruptcy.
An unmarried partner is not an heir. Without a will the estate goes to the children or, if there are none, to parents and siblings; a cohabitation agreement cannot appoint an heir, only a notarial will can. The EU Succession Regulation applies the law of the deceased’s last habitual residence, unless they chose the law of their nationality in a will. Our article on നെതർലൻഡ്സിലെ അനന്തരാവകാശ നിയമം explains the statutory division.
Does your partner receive a partner pension?
That depends on the pension scheme, not on the Civil Code. Most schemes recognise a spouse or registered partner automatically; an unmarried partner usually has to be registered with the fund, often on the basis of a notarial cohabitation agreement.
Many schemes provide partner pension on a risk basis, so cover can end when the participant leaves the employer. Ask the fund in writing and keep the answer.
Who decides if your partner cannot?
Under Article 7:465(3) BW a doctor deals with a person the patient authorised in writing; if there is none, with the spouse, registered partner or other life companion. An unmarried partner who shares a life is therefore on that list.
The problem is proof. A written authorisation, usually in a notarial lasting power of attorney (levenstestament), puts you first in line and avoids disputes with family members.
How are parenthood and parental authority arranged?
A child born during a marriage or registered partnership has the mother’s spouse or partner as second legal parent by law, with specific conditions for a female partner. Unmarried partners have no automatic tie: the second parent must acknowledge the child (erkenning) at the registrar, which can be done before birth.
Since 1 January 2023 an acknowledgement also gives joint parental authority automatically. That rule is not retroactive: for children acknowledged earlier, joint authority must still be registered separately. Dutch nationality by descent follows legal parenthood; for a child acknowledged by an unmarried Dutch father, the timing of the acknowledgement matters. Our glossary entry on ഒരു കുട്ടിയുടെ അംഗീകാരം നടപടിക്രമം വിശദീകരിക്കുന്നു.
Which documents and formalities do you need?
A marriage or partnership starts with a notification of the intended ceremony at the municipality, at least fourteen days before the ceremony (Article 1:62 BW). The partner from abroad usually needs a valid passport, a birth certificate and proof of unmarried status from the country of origin.
Foreign documents must be authenticated. For countries party to the 1961 Apostille Convention an apostille is enough; for other countries the legalisation chain runs through the foreign ministry and the Dutch embassy. A sworn translation is often required, and municipalities usually want recent civil-status documents, so start about three months ahead. A marriage concluded abroad must also be authenticated before it can be registered in the BRP.
Cohabiting couples go to a civil-law notary instead. A partner who does not speak Dutch can have the deed explained through an interpreter. Arrange the cohabitation agreement, mutual wills and the lasting power of attorney in one session.
What happens if the relationship ends?
A marriage can only be dissolved by the court, on a petition filed by a lawyer; a registered partnership without minor children can be ended out of court by an agreement registered by the registrar (Article 1:80c BW). With minor children, a partnership also goes through the court. See our pages on the വിവാഹമോചന നടപടിക്രമം പിന്നെ രജിസ്റ്റർ ചെയ്ത പങ്കാളിത്തം അവസാനിപ്പിക്കുന്നു.
For international couples, first establish jurisdiction: the EU regulation on matrimonial matters decides which country’s court may hear the case, mainly based on habitual residence and sometimes common nationality. On the divorce itself a Dutch court applies Dutch law (Article 10:56 BW), unless the spouses jointly chose the law of their common foreign nationality. The law on property, maintenance and the divorce itself can differ.
ഡിവിഷൻ, പരിപാലനം, കുട്ടികൾ
On divorce the community of property is divided equally, and pension rights built up during the marriage are in principle equalised under the Pension Rights Equalisation Act (WVPS). Spousal maintenance for petitions from 1 January 2020 runs for half the marriage, at most five years, with three statutory exceptions (Article 1:157 BW).
With minor children a parenting plan is compulsory. Moving abroad with a child requires the other parent’s consent or the court’s permission; taking a child abroad without it is child abduction under the Hague Convention, with a summary return procedure.
Cohabiting partners have no statutory division, maintenance or pension equalisation. The end of the relationship is also an immigration event: a residence permit based on the relationship can be withdrawn, so the വിദേശ പങ്കാളി should take advice immediately.
What should you check if you marry or register a partnership?
Most problems arise because couples assume Dutch law applies when it does not. Check these points before the ceremony.
- Where you will first live together after the wedding, and whether you need a notarial choice of law for your property regime.
- Whether the limited community of property suits you, or whether a prenuptial agreement must be signed before the wedding day.
- Whether all foreign documents have an apostille or legalisation and a sworn translation.
- Whether the sponsor meets the current IND income requirement and the partner needs the civic integration exam abroad.
- Whether your wills reflect the EU Succession Regulation if either of you has assets abroad.
What should you check if you live together without registering?
As cohabitants you must build your protection yourselves. Check these points while you are both healthy and in agreement.
- A notarial cohabitation agreement recording ownership of the home and the division of costs.
- Mutual notarial wills, because a cohabitation agreement cannot appoint an heir.
- Registration of your partner with each pension fund.
- A lasting power of attorney (levenstestament) for medical and financial decisions.
- Acknowledgement of your child at the registrar, preferably before birth.
- For the foreign partner: proof that you keep living together, and timely renewal of the residence permit.

What happens if we married outside the Netherlands?
A valid foreign marriage is in principle recognised. To have it recorded in the Personal Records Database (BRP), you take the authenticated foreign marriage certificate, with an apostille or legalisation and usually a sworn translation, to your municipality.
Can we marry in the Netherlands while my partner is on a tourist visa?
Yes, if the documents are in order and the notification is made at least fourteen days before the ceremony (Article 1:62 BW). The marriage does not give a right of residence: your partner will usually have to return and apply for an mvv from abroad.
രജിസ്റ്റർ ചെയ്ത പങ്കാളിത്തം വിവാഹത്തിന് തുല്യമാണോ?
Almost. Property, inheritance and maintenance rules are largely the same, and the IND treats both alike. The main difference is that a registered partnership without minor children can be ended without a court (Article 1:80c BW).
What does a cohabitation agreement not cover?
It cannot make you your partner’s heir; only a notarial will can. Pension registration with the fund and a lasting power of attorney for medical decisions also have to be arranged separately.
